Terms of Service

1. Agreement to these Terms

These Terms of Service ("Terms") form a binding contract between you ("you", "your") and Onefancam ("we", "us", "our") and govern your access to and use of the Onefancam website, mobile site, applications, APIs and any related services (collectively, the "Service").

By creating an account, signing in, uploading content, or purchasing a video, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

2. Who we are

The Service is operated by Onefancam, a company organized under the laws of France. Our contact address for legal notices is the email listed in section 23. Specific corporate identification details (legal form, registered office and SIREN number) are published in our legal mentions and updated as the entity is registered.

3. The Service

Onefancam allows you to upload a still image, choose a sport context, and receive an AI-generated short video that simulates an appearance on a stadium projector. The output is fully synthetic: it does not record, capture, or document any real event. Outputs may include simulated crowds, stadiums, broadcast graphics and ambient audio.

The Service is provided over the internet. We may add, change, or remove features (including sports, models, output resolutions, or durations) at any time to improve quality, safety or commercial viability.

4. Eligibility and account

You must be at least 16 years old to use the Service and to provide your personal data to us. If you are under the age of majority in your country, you may use the Service only with the consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

You typically sign in with Google. You are responsible for keeping your sign-in credentials secure, for everything that happens under your account, and for the accuracy of the information you provide. We may refuse to create or maintain an account for any user at our reasonable discretion, including in cases of suspected abuse, circumvention of a prior ban, or sanctioned jurisdictions.

5. Your content (the photo you upload)

"Your Content" means any photo, prompt, description or other material you submit to the Service. You are solely responsible for Your Content and for the consequences of submitting it.

By uploading any photo, you represent and warrant that:

• you own all rights to the photo, or have a documented, freely-given permission from the rights holder and from every identifiable person depicted, to upload the photo and to create an AI-generated video from it;
• the photo depicts you, or a person who is at least 18 years old and who has given you explicit, informed consent to be depicted in an AI-generated fan-cam style video that you will own and may share publicly;
• the photo does not depict a minor other than yourself; does not depict a public figure, celebrity, athlete, performer, politician or any other third party without their verifiable consent; and does not depict any individual in a way that could mislead viewers into believing the synthetic video is real footage of that person; and
• the photo, the prompt, and the intended use do not infringe any intellectual property right, privacy right, image right, right of publicity, contractual obligation or applicable law.

If you submit a photo of another person, you are solely responsible for obtaining and being able to evidence that person's prior, informed, written consent. We may request a copy of that consent at any time and may suspend or terminate your account if you cannot produce it. Submitting a photo of another person without valid consent is a material breach of these Terms and may expose you to civil and criminal liability under applicable image-rights laws.

6. License you grant us

You retain all rights you have in Your Content. To run the Service, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, copy, transmit, transcode, display, modify and create derivative works of Your Content, solely for the purposes of:

• operating, providing and improving the Service for you;
• generating, delivering and storing the AI output you requested;
• enforcing these Terms, complying with law, and responding to legal requests; and
• aggregating anonymous, non-identifying technical signals for analytics and abuse prevention.

We do not use Your Content to train our AI models, nor do we license Your Content to third parties for model training. Our upstream model providers process Your Content under contractual commitments that prohibit model training on user inputs and outputs. See our Privacy Policy.

This license terminates when you delete Your Content, your account or your generated video, except (i) for the limited period during which deletion propagates through our backups, and (ii) where we must retain a copy to comply with law, resolve disputes, or enforce these Terms.

7. Generated videos and ownership

Subject to your compliance with these Terms and payment of any applicable fee, you own the AI-generated video produced for you ("Output"), to the maximum extent the output of a generative AI system can be owned under applicable law. You may post, monetize, edit and share your paid Output on TikTok, Instagram, YouTube and similar platforms, including for commercial purposes.

The following clarifications apply:

• Free-tier Outputs are licensed to you for personal and promotional use of Onefancam. The Onefancam watermark must remain intact.
• We may, by default, use your Output, an anonymized thumbnail of it, or a non-identifying excerpt to showcase the Service publicly (for example on our website, social channels or ads). You can opt out at any time by emailing us. If your Output depicts a person other than yourself, please opt out unless you have that person's express consent to such promotional use.
• You are responsible for complying with the rules of any platform where you publish the Output, including any synthetic-media disclosure requirements.
• Because two users may upload similar prompts or photos, similar Outputs may exist. We make no exclusivity guarantee over a given stylistic result.

8. Watermark and free tier

Free videos include a small "onefancam.ai" watermark. You agree not to remove, obscure, alter, or hide the watermark on a free video, and not to use third-party tools to do so. Paid videos are delivered without a watermark.

9. Acceptable use and prohibited conduct

Generative AI is powerful, and we take its safe use seriously. You must not use the Service, and must not upload content, in order to:

• create sexual, sexually suggestive, nude, semi-nude or otherwise adult content; or content involving anyone who appears to be under 18;
• create non-consensual intimate imagery, "deepfake" pornography, or any sexualized depiction of a real person;
• impersonate a real person in a way intended or likely to deceive viewers, defame, harass, blackmail, threaten, bully, dox or harm them;
• generate political propaganda, election interference content, or synthetic statements falsely attributed to public figures;
• incite or glorify violence, terrorism, self-harm, hate or discrimination based on a protected characteristic;
• infringe any copyright, trademark, image right, publicity right, team or league trademark, sponsorship right, broadcaster mark or other intellectual property;
• violate the privacy or data-protection rights of any person, including by uploading another person's image without their explicit consent;
• engage in fraud, deception, money laundering, scams, phishing or any unlawful activity;
• attempt to reverse engineer, decompile, scrape, mass-download, probe or interfere with the Service, its models, its prompts or its infrastructure; circumvent any rate limit, paywall, watermark or safety filter; or use bots, automation or shared accounts to obtain more free videos than intended;
• resell, sublicense, or expose the Service to third parties as if it were your own product, including white-label use, without our prior written agreement; or
• generate content that violates any law applicable to you, to the person depicted, or to the audience you target.

We use automated and human-in-the-loop moderation. We may refuse a generation, reject an upload, blur or redact output, freeze credits, suspend or terminate your account, and report you to competent authorities if we reasonably suspect a violation. We do not have an obligation to monitor user activity but we reserve the right to do so.

10. Pricing, payments and credits

Onefancam is sold per video, with no subscription. Current prices are displayed on our pricing page and may change for future purchases at any time without prior notice. The price applicable to a given purchase is the price displayed at checkout.

• Payments are processed by our payment partner (currently Stripe). You authorize us and our payment partner to charge the payment method you provide for the amount displayed at checkout, including applicable taxes (VAT where relevant).
• When you buy a pack of videos, the included videos are added to your account as non-transferable credits, tied to your account, and usable only on the Service. Credits do not expire while your account is active.
• Prices shown are inclusive of VAT for consumers located in the European Union unless explicitly stated otherwise. Business users must provide accurate VAT details if applicable.
• We may revoke unused credits if we reasonably determine your account has engaged in fraud, chargeback abuse, credit-card abuse, or violations of section 9.

11. Refunds and EU withdrawal right

System failures are refunded. If a generation fails because of a problem on our side (server error, model crash, corrupt output, etc.), we automatically refund the credit consumed, so you only pay for videos that are actually delivered.

Aesthetic dissatisfaction is not a refund ground. Because AI-generated outputs are inherently variable and largely depend on the photo you upload and the prompt you provide, we do not issue refunds because you find a delivered video less flattering, less viral or less realistic than expected. Please use your free first-trend video to evaluate the Service before paying.

EU consumers. Under Article L221-28 of the French Consumer Code (transposing Directive 2011/83/EU), the 14-day right of withdrawal does not apply to (i) digital content delivered immediately after your prior express consent and acknowledgement that you lose your withdrawal right, and (ii) goods made to your specifications or clearly personalised. AI-generated videos created from your photo and your chosen sport fall under both exceptions. By starting a generation, you expressly consent to immediate execution and acknowledge that you waive the 14-day withdrawal right for delivered videos and for the credits already consumed.

Unused credits. If you change your mind within 14 days of purchase and have not consumed any credit of the pack you bought, contact us at contact@onefancam.com and we will refund the unused balance.

12. Nature of AI-generated content

The Service is powered by generative AI models. You acknowledge that:

• outputs are synthetic and probabilistic, and may contain visual artifacts, anatomical inconsistencies, inaccurate sport equipment or apparel, fictional logos, fictional crowds, fictional stadium architecture, or differences from the photo you uploaded;
• we do not represent that the Output will match your expectations, a specific likeness, a specific celebrity look, a specific stadium, a specific brand, or a specific quality threshold;
• identical or similar inputs may produce different outputs across generations;
• outputs are not footage of real events, real broadcasts or real attendances. You must not represent them as such; and
• we cannot guarantee that any platform will host, monetize, or allow Outputs you publish, given their evolving rules on AI-generated content.

13. Our intellectual property

We and our licensors own all rights in and to the Service, including the website, app, brand, models, prompts, training data, code, design system, and any related material. Except as expressly set out in these Terms, no rights are granted to you. You may not copy, modify, distribute, sell, lease, host, or create derivative works of the Service, and you may not use the Onefancam name, logo, or trademarks without our prior written consent.

14. Third-party services

The Service relies on third-party providers, including (but not limited to) cloud hosting, payment processing, authentication, analytics, error monitoring, email delivery and upstream AI model providers. Your use of the Service is also subject to those providers' terms. We are not responsible for third-party services we do not control, and we may change providers at any time to keep the Service reliable. See our Privacy Policy for the current list and what each provider receives.

15. Suspension and termination

You may stop using the Service and delete your account at any time by emailing contact@onefancam.com. Termination does not automatically refund any consumed credit.

We may suspend, restrict, or terminate your account and any unused credits without notice and without refund if we reasonably believe that (i) you have breached these Terms, (ii) you have engaged in prohibited conduct under section 9, (iii) your activity exposes Onefancam, our users or a third party to legal, financial, security or reputational risk, (iv) we are required to do so by law or by a competent authority, or (v) continuing to provide the Service to you is no longer commercially viable.

Sections that by their nature should survive termination (including sections 5, 6, 7, 9, 12, 13, 17, 18, 19, 20 and 22) will continue to apply after the end of these Terms.

16. Copyright and likeness complaints

If you believe content on the Service infringes your copyright, your trademark, your image rights or your right of publicity, send a written notice to contact@onefancam.com with: (a) your full name and contact information; (b) identification of the protected right; (c) a URL or reasonable description of the allegedly infringing material; (d) a statement, under penalty of perjury where applicable, that you are the rights holder or authorized to act on the rights holder's behalf, and that the use is not authorized; and (e) your signature.

We will review valid notices in good faith and may remove the content, suspend the responsible account, and pursue further action against repeat offenders. False or bad-faith notices may expose the complainant to liability.

17. Disclaimers

The Service is provided "as is" and "as available", with all faults and without warranties of any kind. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, statutory or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from a course of dealing or usage of trade.

We do not warrant that the Service will be uninterrupted, secure, error-free, timely, accurate, free of viruses or harmful components, or that any defects will be corrected. We do not warrant that the Output you generate will be lawful for your intended use in your jurisdiction, nor that it will perform on any social platform.

Nothing in this section limits any non-excludable consumer rights you have under applicable law (including under French Consumer Code and EU Directive 2019/771).

18. Limitation of liability

To the maximum extent permitted by law, in no event will Onefancam, its affiliates, officers, employees, agents, suppliers or licensors be liable for any indirect, incidental, consequential, special, exemplary or punitive damages, including loss of profits, loss of revenue, loss of data, loss of goodwill, loss of opportunity, loss of followers or virality, business interruption or reputational harm, whether based on contract, tort (including negligence), strict liability or otherwise, even if we have been advised of the possibility of such damages.

To the maximum extent permitted by law, our aggregate liability to you arising out of or in connection with the Service or these Terms is capped at the greater of (i) the total amount you paid us in the 12 months preceding the event giving rise to the claim, and (ii) one hundred dollars ($100).

Nothing in this section excludes or limits liability that cannot be excluded or limited by law, including liability for gross negligence or wilful misconduct.

19. Indemnification

You agree to defend, indemnify, and hold harmless Onefancam, its affiliates and their respective officers, employees and agents from and against any claim, demand, loss, liability, damage, fine, penalty, cost or expense (including reasonable legal fees) arising out of or related to (i) Your Content, (ii) your breach of these Terms or of any law, (iii) your violation of any third-party right, including any right of publicity, privacy, image right, copyright, trademark or contract, or (iv) your use of any Output, including any publication, monetization, advertisement or commercial exploitation of an Output.

20. Governing law and disputes

These Terms and any non-contractual obligations arising out of or in connection with them are governed by the laws of France, without regard to its conflict-of-laws rules.

Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the competent courts of Paris, France, except where mandatory consumer-protection rules of your country of residence (within the EEA) grant you a more favorable forum.

Before initiating proceedings, you agree to first contact us at contact@onefancam.com so we can try to resolve the matter amicably. EU consumers may also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr.

21. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email (if you have an account) and/or by a prominent notice on the Service at least 14 days before the changes take effect, unless a shorter notice period is required for legal or security reasons. Continued use of the Service after the effective date of the updated Terms means you accept them; if you disagree, your sole remedy is to stop using the Service and delete your account.

22. Miscellaneous

• Entire agreement. These Terms, together with our Privacy Policy and any policies referenced here, constitute the entire agreement between you and Onefancam regarding the Service.
• No waiver. Our failure to enforce any right or provision does not waive that right or provision.
• Severability. If any provision is held invalid or unenforceable, the remaining provisions remain in full force.
• Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms freely, including in connection with a merger, acquisition or sale of assets.
• Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, pandemics, war, strikes, regulatory action, or outages of third-party infrastructure.
• Language. These Terms are originally drafted in English. Translations are provided for convenience only and the English text prevails.
